Please read these Terms of Service (“Terms”) carefully before using the Fodify mobile application (the “App”) operated by BioAI LLC (“we,” “us,” or “our”).

1. Acceptance of Terms

By downloading, installing, or using Fodify, you agree to be bound by these Terms. If you do not agree, do not use the App.

2. Description of Service

Fodify is a dietary tracking and management tool designed to help users follow the low FODMAP diet for managing Irritable Bowel Syndrome (IBS) symptoms. Features and content may change over time, and some are released in stages.

3. Account Registration

• You must create an account to use Fodify.
• You are responsible for maintaining the confidentiality of your account credentials.
• You must provide accurate information and keep it up to date.
• You must be at least 16 years old to create an account.

4. Health Disclaimer

FODIFY IS NOT A MEDICAL DEVICE AND DOES NOT PROVIDE MEDICAL ADVICE.

• The App is a dietary tracking tool. It does not diagnose, treat, cure, or prevent any disease.
• Fodi, the App’s AI guide, provides general information about the low FODMAP diet. It is not a substitute for professional medical advice from a doctor, dietitian, or other qualified healthcare provider.
• FODMAP ratings are guidance, not a guarantee. Some are estimates, and individual tolerances vary. Always verify with your healthcare provider.
• If you experience severe symptoms (blood in stool, unexplained weight loss, severe pain, fever, or vomiting), seek immediate medical attention.
• Do not disregard professional medical advice or delay seeking it because of information provided by the App.

5. Subscriptions and Payments

• Fodify is free to use, with usage limits. Fodify Plus is a paid subscription that raises those limits and unlocks more features. Usage limits still apply to Fodify Plus. What each plan includes is shown in the App before you buy.
• Subscriptions are billed through Apple App Store or Google Play Store.
• Prices are displayed in the App before purchase and may vary by region.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
• If a free trial is offered, it becomes a paid subscription when the trial ends unless you cancel at least 24 hours before it ends.
• You can manage and cancel subscriptions in your device’s App Store/Play Store settings.
• Refunds are handled by Apple or Google per their respective refund policies.
• We do not process payments directly and cannot issue refunds ourselves.

6. User Content

• You retain ownership of all content you create in the App (food logs, photos, notes, chat messages).
• By using the App, you grant us a limited license to process your content as necessary to provide the service.
• Foods you add to the App become part of the shared food database, which other users can see.
• Foods you add must not contain objectionable content. We remove it, and we act on reports of it within 24 hours.
• We do not use your personal content to train AI models.
• You are responsible for the accuracy of information you log.

7. AI Features

• Some features, including Fodi, are powered by third-party AI services.
• AI responses may occasionally be inaccurate. Always verify important dietary decisions with your healthcare provider.
• We do not guarantee the accuracy, completeness, or reliability of AI-generated content.

8. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose.
• Attempt to reverse engineer, decompile, or extract source code from the App.
• Interfere with or disrupt the App’s servers or networks.
• Create multiple accounts to circumvent free tier limits.
• Upload malicious content, spam, or inappropriate material.
• Impersonate another person or entity.
• Use automated tools to access the App (bots, scrapers, etc.).

9. Intellectual Property

• Fodify, its design, code, icons, and content are owned by BioAI LLC or its licensors and protected by copyright and trademark laws.
• The Fodify name, logo, and the Fodi character (the App’s icon) are trademarks of BioAI LLC.
• The food database and its FODMAP ratings are our editorial work product.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Fodify is provided “AS IS” without warranties of any kind, express or implied.
• We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
• We are not liable for any health outcomes resulting from dietary decisions made using the App.
• Our total liability for any claim arising from your use of the App shall not exceed the amount you paid us in the 12 months preceding the claim, or $50, whichever is greater.
• We are not liable for indirect, incidental, special, consequential, or punitive damages.

11. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless BioAI LLC from any third-party claims, damages, or expenses arising from your violation of these Terms or your misuse of the App.

12. Termination

• You may delete your account at any time from Settings → Privacy & data → Delete my account. Deletion is scheduled for 7 days after your request, as described in our Privacy Policy.
• Deleting your account does not cancel a subscription. Cancel it in your device’s App Store or Play Store settings.
• We may suspend or terminate your access if you violate these Terms.
• Upon termination, your right to use the App ceases immediately. Data deletion follows our Privacy Policy.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms at https://fodify.app/terms and updating the “Last updated” date. Continued use after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of New York, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of New York.

15. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
